Samsung Responds To Tab Galaxy Win Apple Tipped To Appeal

4.00pm Friday is the witching hour for Samsung after Apple were told that they only had two days to lodge an appeal to the High Court after the Korean manufacturer of the Galaxy Tab won its fight against a court order banning the sale of its Galaxy tablet computer in Australia.

According to Tyler McGee Vice President of Communications at Samsung Australia “The champagne corks will be popping” if his Company is allowed to sell the in demand device before Xmas.

Insiders are tipping that Apple will appeal with one lawyer close to the case saying “If only to stop Samsung selling the device”.

The full bench of the Federal Court today unanimously reversed a Federal Court judge’s ruling last month that Samsung’s Galaxy Tab 10.1 be banned from sale in Australia.

The judgment handed down in Sydney today saw Apple granted a short stay till 4.00PM Friday.

According to Mcgee Samsung will immediately put the Galaxy Tab on sale in its original configuration if Apple fails to appeal. “We have to sit and wait” he said.

“I think that if you wish to extend that stay you will have to do that in the High Court,” Justice Lindsay Foster told Apple.

Samsung claimed that Justice Bennett of the Federal Court failed in her judgement when she ordered its Galaxy Tab 10.1 to be banned from sale in Australia, Justice Annabelle Bennett, “misunderstood and misapplied” basic requirements of the law and elements of her reasoning were “grossly unjust” the Appeal Court ruled.
