Activision is being sued by two former employees for US$36 million for ‘breach of contract, breach of the implied covenant of good faith and fair dealing, and wrongful termination in violation of public policy.’

Jason West and Vince Zampella were responsible for creating “Call of Duty” and “Modern Warfare” but were fired right before receiving their royalties for “Modern Warfare 2”.
“Activision fired them in the hope that by doing so, it could avoid paying them what they had rightfully earned, and to seize control over Infinity Ward Studio, to which Activision had previously granted creative control over all Modern Warfare branded games and had, apparently, decided it no longer wanted to live with,” said the 16-page complaint.
“Instead of thanking, lauding, or just plain paying West and Zampella for giving Activision the most successful entertainment product ever offered to the public, last month Activision hired lawyers to conduct a pretextual ‘investigation’ into unstated and unsubstantiated charges of ‘insubordination’ and ‘breach of financial duty.’ It then summoned Mr West and Mr Zampella to a sham meeting two days ago at Activision’s headquarters in Santa Monica, California, during which they were fired on the basis of false and trivial charges, and then quickly escorted out the back door,” continued the document.
The Call of Duty brand has achieved approximately US$3 billion life-to-date revenue, while Modern Warfare 2 had generated more than US$1 billion in retail sales worldwide.
Activision has issued a statement to various online websites saying that the claims are meritless.
