Feisty Samsung Vows ‘All Measures’ To Fight Apple

Samsung have come out all guns blazing in its ongoing tabs fight in Australia with Apple. In a statement released this afternoon, the maker of the Galaxy 10.1, insists the Android Tab is “innovative” and vowed to do everything possible to bring it Down Under.

The Android Galaxy Tab 10.1, is currently banned from sale here, following Apple’s claims that it infringes a number of intellectual patents it owns including touch and swipe technology and “slavishly” copies the iPad.

The case, heard before a three-judge panel in Sydney Federal court today, saw no verdict passed down this afternoon.

But Samsung insist it will fight foe Apple and “take all available measures” to ensure the Android Tab 10.1, tipped as a hot contender to the iPad 2, is sold in Oz.

Samsung told the court today that the injunction banning the sale of the device, handed down last month should have been refused.

Lawyers for the Korean giant also revealed how Apple had a “range of undertakings they were insisting on from Samsung” before it would concede to an early trial, which in effect stalled the matter from being resolved at earlier date, something which Samsung desired, since it was fast losing sales and goodwill attached to the device.

The Koreans deny Apple’s claims of infringement insist the Android Tab 10.1 is “innovative”.

“No decision was handed down by the court today regarding the validity of the preliminary injunction on sales of the Samsung GALAXY Tab 10.1,” Samsung Australia said in a statement this afternoon.

“We have appealed on the grounds that Apple has failed to establish a case sufficient to justify an injunction that blocks market access for our product. ”

“Samsung will continue to assert our position that our GALAXY Tab 10.1 is innovative and does not infringe Apple’s intellectual property rights, and take all available measures to ensure our tablet device are available to consumers in Australia.”

The case continues next week.
