Samsung and Apple’s tit-for-tat patent battle has taken an uncharacteristic turn after Samsung withdraw a plea to ban Apple’s products in Europe.
Samsung said it wanted to compete “fairly in the marketplace, rather than in court.” However, The independent reports Samsung will continue pressing Apple over alleged patent infringements.
The move follows a Samsung win in America after Apple’s motion to have some Samsung Galaxy smartphones and tablets banned was rejected.
The judge presiding over the case, Justice Lucy Koh, said “though Apple does have some interest in retaining certain features as exclusive to Apple, it does not follow that entire products must be forever banned from the market because they incorporate, among their myriad features, a few, narrow protected functions.”
Although Apple couldn’t get the products banned, American courts did recognise in August Samsung had imitated features key to Apple’s devices and was awarded $1.05 billion in damages.
