The Australian Competition and Consumer Commission (ACCC) said only minutes ago that Telstra has dropped its appeal against findings that the marketing of its Next G mobile phone network was misleading.

The ACCC has instituted proceedings in the Federal Court against Telstra in September of last year for alleged contraventions of the Trade Practices Act 1974 in relation to the promotion of its Next G network.
The ACCC alleged that Telstra had engaged in misleading or deceptive conduct by representing that the Next G mobile network “covers the entire country” and has “coverage everywhere you need it”.
The ACCC said that these representations contravened sections 52 and 53 of the Act.
The Federal Court then ruled that Telstra had been deceiving by claiming that Next G gives coverage equal to or better than the CDMA network.
Telstra must now pay the ACCC’s legal costs.
