BREAKING NEWS: Samsung Deliberately Breached Apple Patents OZ Court Hears Today

A Federal Court Judge has been told by Samsung that intends to launch its controversial 10.1 Galaxy Tab this coming Friday in Australia.

A Federal Court Judge has been told by Samsung that intends to launch its controversial 10.1 Galaxy Tab this coming Friday in Australia.

Lawyers for Apple told Justice Bennet Samsung had deliberately copied the iPad 2 design, in addition to its capabilities.

“Not only have they copied the iPad 2, they have copied as many features of the device as they can” claimed Steven Burley, Apple’s legal counsel.

Burley continued by claiming Samsung’s strategy appears to be one where they are aware of Apple patents and launch products breaching them anyway. And if caught they try to work around it as they have done with their so called Australian version of their Galaxy Tab.

The court heard that on the first of August Samsung Australia gave notice that they would launch the US version of their 10.1 Galaxy Tab. When this was contested by Apple they 3 weeks later developed an Australian edition of the Galaxy 10.1.

Counsel for Apple handed up a schedule of differences that were supplied to Apple by Samsung. They described these changes as cosmetic, while there were changes to both hardware and software. It was clear that Samsung is trying to work around Apple patents.

 

They had blatantly failed an apple attorney said.

At today’s hearing before a packed court, large video screens have been put in place with a view to Apple executives and patent designers being allowed to give oral evidence.

Representing Samsung, Lawyer David Catterns told the court that of the 4 patents being contested by Apple that Samsung had removed a zoom feature from their new Galaxy tab, with the case now centred on the remaining 3 key patents.
